Privacy Policy and KVKK Notice

This Notice has been prepared to inform users, under Law No. 6698 on the Protection of Personal Data (“KVKK”), about the personal data processed while using the Sketch to Studio (“STS” or “Platform”) services.

Depending on the services used and the relationship established with the user, the following personal data may be processed while using STS:

Identity information: first and last name.

Contact information: email address and any other contact details voluntarily shared by the user through communication channels.

Account and membership information: user account details, membership and account status, account creation and login information, and records/timestamps of reading and accepting the Terms of Use and related texts.

Transaction and usage information: transactions carried out on STS, technical information necessary for project and work records, image generation usage records, free or paid image generation usage information, transaction dates, and technical transaction logs.

Technical data: IP address, browser and device information, session and security logs, system error and performance logs, and log records required for Platform security.

Content and image data: uploaded sketches, design images, descriptions related to the design, part, material, surface, and color information, AI-generated refined sketches and other image outputs, design analyses, reports, and related content.

Payment and transaction information: for paid services, transaction, order, and payment status information necessary to process and record payments may be processed. On infrastructure where bank or credit card details are not stored directly by STS, such information is subject to the payment service provider's own privacy and data protection terms.

Personal data may be processed for purposes such as creating and managing the user account, identity and session verification, providing STS services, managing projects and work records, analyzing sketches, and generating AI-supported outputs and CMF reports.

It may also be processed for tracking free and paid usage, billing and payment, responding to support requests, ensuring security, preventing abuse, resolving technical issues, improving service performance, fulfilling legal obligations, responding to lawful requests from competent authorities, and protecting legal rights.

STS is a service that processes users' product design sketches and design work.

Sketches uploaded by the user, design images, and related information are processed solely to provide STS services and to carry out the actions requested by the user.

Intellectual property rights to the sketches and designs uploaded by the user to the Platform remain with the relevant rights holder.

STS carries out only the operations necessary for the technical delivery of the service on designs uploaded by the user. Other principles are explained in the Terms of Use and Design Rights Agreement.

STS is not a long-term image or design archiving service.

Sketches uploaded by the user and image assets generated by the Platform are stored temporarily for the purpose of providing the service. Under the current system policy, these image assets are intended to be automatically deleted within approximately 24 hours.

STS does not guarantee that images deleted after this period can be recovered. The user must save to their own device any image outputs they wish to keep.

Account information, membership records, usage/transaction records, payment and accounting records, and other data that must be legally retained may be kept for periods different from those applicable to images, to the extent required by applicable legislation.

Personal data may be collected electronically through the STS website and application, membership and login screens, Google or similar authentication services, content uploaded by the user, project and work areas on the Platform, contact and support forms, payment systems, and system, server, and security logs.

Personal data is processed based on the applicable personal data processing conditions specified in Article 5 of KVKK.

These include, in particular, cases where processing is directly related to the establishment or performance of a contract; is mandatory for the data controller to fulfill a legal obligation; is mandatory for the establishment, exercise, or protection of a right; and is mandatory for the data controller's legitimate interests, provided that this does not harm the fundamental rights and freedoms of the data subject.

Where a personal data processing activity requires explicit consent, that activity is additionally subject to an explicit consent mechanism. Reading or being presented with this KVKK Notice does not, on its own, constitute the granting of explicit consent.

STS may make use of various third-party technology and infrastructure providers to deliver its services.

Personal data may be transferred to providers of cloud infrastructure and data hosting, authentication, artificial intelligence and image generation, payment, technical infrastructure, security, and error-monitoring services, and, where legally required, to competent public authorities and institutions.

Transfers are carried out only to the extent necessary for providing the service, operating the technical infrastructure, ensuring security, or fulfilling legal obligations.

The servers or data processing infrastructure of some cloud, authentication, and artificial intelligence service providers used within STS may be located outside Türkiye.

Where it is necessary to transfer personal data abroad, the transfer is carried out in accordance with KVKK's provisions on cross-border data transfer and applicable legislation. The necessary transfer mechanisms, agreements, safeguards, and/or explicit consent processes are applied separately.

Personal data is retained for the period required by the purposes of processing and taking into account the statutory retention periods set out in applicable legislation.

When the reasons requiring processing cease to exist, personal data is deleted, destroyed, or anonymized in accordance with applicable legislation.

STS's approximately 24-hour temporary storage policy applies to image assets. Where legal, financial, security, or transaction records are mandatory, the relevant records may be retained for the required period.

Under Article 11 of KVKK, you have the right to learn whether your personal data is being processed, to request information if it has been processed, to learn the purpose of processing and whether it is used in accordance with that purpose, and to know the third parties to whom it has been transferred domestically or abroad.

You also have the right to request correction of incomplete or inaccurate data; to request deletion or destruction of data once the conditions for doing so are met; to request that these actions be notified to third parties to whom the data has been transferred; to object to a result that is to your detriment arising from analysis by automated systems; and to request compensation for damages arising from unlawful processing.

Your request should include your first and last name; your signature if submitted in writing; your Turkish ID number if you are a citizen of the Republic of Türkiye, or your nationality, passport number, or other identification number if you are a foreign national; the address to which notice should be sent; your email, phone, and fax number if available; and the subject of your request.

Requests are evaluated and concluded according to their nature and within the periods stipulated by applicable legislation.

This Notice may be updated if STS's services, the technologies used, or applicable legislation change. The current version of this Notice is kept accessible to users on the Platform.
