Terms of Use and Design Rights Agreement

This English version is provided for informational purposes only. In the event of any discrepancy or inconsistency, the Turkish version shall prevail.
These Terms of Use ("Terms") set out the rules governing the use of the services offered through Sketch to Studio ("STS", "Platform").
By using the Platform and/or creating a user account, you confirm that you have read and accepted these Terms.
1. Description of the Service
Sketch to Studio is a digital service that helps users analyze their product design sketches with AI-powered tools, clarify the design information contained in their sketches, create refined sketches and line-art images, and prepare their designs for use in AI-based visualization systems.
STS is not an engineering verification, design registration, patent search, or legal compliance service.
The analyses, suggestions, refined sketches, prompts, and other outputs generated by the Platform are provided to assist the user and do not replace professional design decisions.
2. User Account
Creating a user account may be required to use some features of the Platform.
The user is responsible for ensuring that the information provided during registration is accurate and up to date, and for keeping their account secure.
If unauthorized use of a user account by a third party is noticed, STS should be contacted.
3. Sketches and Designs Uploaded by the User
Intellectual property rights to the sketches, designs, images, and other content that the user uploads to STS belong to the relevant rights holder.
STS does not claim ownership over any design or sketch uploaded by the user.
By uploading content to the Platform, the user grants STS the necessary right of use and processing solely for the purpose of providing the service under STS's operations.
This permission does not mean that STS may use the content as its own commercial design, sell it, or acquire ownership rights over the design.
4. User Responsibility for Content
The user represents and warrants that the sketches, designs, images, and other content uploaded to the Platform belong to them, or that they hold the necessary permissions to use and process such content; that the content does not infringe the intellectual property, design, trademark, patent, copyright, trade secret, or other rights of third parties; and that it does not contain unlawful content.
The user must not upload a confidential or rights-protected design belonging to another designer, company, client, or third party without obtaining the necessary permissions.
Legal liability arising from the unauthorized upload or use of such content belongs to the user.
5. Confidential and Commercial Designs
As STS may be used in professional design processes, it is aware that users may upload product ideas that have not yet been publicly disclosed, client projects, work of a trade-secret nature, or designs with an ongoing registration/patent process.
However, the user is responsible for checking whether uploading content to an external digital or AI service is permitted under any confidentiality agreements (NDAs), employment agreements, client agreements, or similar obligations entered into with third parties.
Use of STS does not remove the confidentiality or intellectual property obligations the user has towards third parties.
6. Use of Artificial Intelligence and the Nature of the Outputs
Some parts of the STS services make use of artificial intelligence technologies.
Because AI systems operate probabilistically, the analyses, refined sketches, drawings, descriptions, prompts, or other outputs generated may not always fully and accurately interpret the user's design.
STS does not guarantee that outputs generated by artificial intelligence are fully accurate, original, unique, producible, registrable, or entirely free of third-party intellectual property rights from a design standpoint.
The user is responsible for reviewing the generated outputs based on their own design knowledge and professional judgment.
Necessary research and legal checks must be carried out separately by the user, particularly for works intended for commercial use, mass production, or patent or design registration.
7. STS's Role in the Design Process
The purpose of STS is not to design on the user's behalf or to own the design decision.
The Platform helps AI systems better understand the design based on inputs provided by the user, such as sketches, descriptions, part definitions, and material, surface, and color information.
The final decision and responsibility regarding the use, modification, development, transfer to production, or commercial use of the generated output belong to the user.
8. Storage of Images
STS is not a long-term design or image archiving service.
Sketches uploaded to the Platform and image assets generated by the Platform may be stored temporarily for the purpose of providing the service and may be automatically deleted within approximately 24 hours under the current system policy.
The user is responsible for saving to their own device any outputs they wish to keep within this period.
STS does not guarantee that images deleted after the temporary storage period can be recovered.
Trial projects created without signing in, including related project information and image assets, may also be temporarily retained for approximately 24 hours. If the user creates an account or signs in within this period, the temporary project may be associated with that user account.
Where a user reports a problem with a generated image, the reported image may be retained for up to 7 days for the purpose of reviewing the report.
Certain data necessary for the operation of the service, such as account, usage, transaction, and payment records, may be retained for a longer period in line with applicable legislation and STS's data retention policies.

9. Third-Party Technologies
STS may make use of third-party technology providers in areas such as artificial intelligence, cloud infrastructure, authentication, payment, or similar fields to provide certain functions of the service.
Therefore, some data sent by the user to the Platform may be processed by the relevant service providers for the technical delivery of the service.
Situations requiring personal data to be shared with third-party service providers or transferred abroad are handled in accordance with applicable personal data protection legislation, and the necessary disclosures are made in the relevant KVKK texts.
10. Prohibited Uses
The user may not use STS for unlawful purposes; to infringe the designs or intellectual property rights of third parties; in a manner that disrupts the security or operation of the Platform; by attempting unauthorized access; or through automated systems that abuse the service.
STS reserves the right to restrict or terminate access to an account if abuse or unlawful activity is detected.
11. Paid Services
Some of STS's image generation services may be offered on a paid basis.
Pricing is clearly shown to the user before a purchase is made.
Any free first use, campaign, or similar arrangement is subject to the conditions determined by the Platform.
Billing and refund principles for failed or technically incomplete transactions are applied within the framework of the current payment terms shown to the user on the Platform.
If a user believes that a completed image generation contains a problem related to the Platform's refinement process, the user may submit a report regarding that generation. Submitting a report does not automatically entitle the user to a refund or restoration of image credits. Following review, STS may restore the image credit used for the reported generation where appropriate.
12. Continuity of the Service
STS does not guarantee that the service will operate uninterrupted or error-free.
The service may be temporarily unavailable due to maintenance, infrastructure issues, third-party service outages, or technical reasons.
STS may make changes to features and technical infrastructure in order to improve the Platform's security, performance, or service quality.
13. Limitation of Liability
To the extent permitted by applicable law, STS cannot be held liable for damages arising from content uploaded by the user to the Platform, from such content infringing the rights of third parties, from AI outputs being used by the user without review, or from such outputs being used in production, investment, registration, client presentations, or other commercial decisions.
The service provided by STS is not a design verification or legal compliance system that replaces the professional judgment of a designer.
This provision does not remove consumer rights and other legal rights that cannot be limited or waived under applicable legislation.
14. Intellectual Property
Intellectual property rights in the STS brand, software, user interface, system architecture, original texts, visual identity, and other elements of the Platform belong to STS or the relevant rights holders.
This provision does not mean that ownership of the sketches and designs uploaded by users to the Platform passes to STS.
To the extent permitted by applicable law and the terms of the third-party services used, STS does not otherwise claim ownership over the outputs generated for the user through the Platform. The user may use these outputs in their own design work and commercial activities. However, STS does not guarantee the protectability, originality, or freedom from third-party rights of AI outputs under intellectual property law.
15. Termination of the Account
The user may request that their account be closed.
STS may restrict the user's access or terminate their account in the event of serious or repeated breaches of the Terms of Use, unlawful use, or activities that threaten the security of the Platform.
Records that are legally required to be retained after account closure may be kept for the applicable statutory periods.
16. Changes to the Terms of Use
STS may update these Terms of Use due to changes in the services or applicable legislation.
In the event of material changes, users will be informed through appropriate means, and renewed consent will be obtained where required by legislation.
The current Terms of Use are kept accessible on the Platform.
17. Governing Law
These Terms of Use are governed by the laws of the Republic of Türkiye.
The rights of consumer users to competent authorities and courts arising from applicable consumer legislation are reserved.
